Agreement to these terms

By registering for or using the OrthoPlanner platform ("Service") operated by Dr. Fernando Moraleda Gómez and Jorge Gonzalez Villaumbrosia ("we", "us", "our"), you agree to be bound by these Terms of Service. If you are accepting on behalf of a dental clinic or other organisation, you represent that you have authority to bind that organisation. If you do not agree to these terms, do not use the Service.

Description of service

OrthoPlanner is a B2B remote orthodontic treatment planning platform. We provide UK and Ireland dental clinics with specialist-level ClinCheck planning, auxiliary protocol sheets, and case monitoring through a secure web portal. The Service requires a subscription and is intended for use by qualified dental professionals only.

Accounts and registration

To access the Service you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your account information up to date.
  • Keep your login credentials confidential and not share them with third parties.
  • Be responsible for all activity that occurs under your account.
  • Notify us immediately at orthoplanners.mv@gmail.com if you suspect any unauthorised use of your account.

Subscription and payment

Access to the Service is subject to a paid subscription:

  • Subscription fees are charged in advance on the agreed billing cycle (monthly or upfront for the commitment period).
  • Payments are processed by Stripe. By providing payment details you authorise Stripe to charge the applicable fees.
  • All fees are exclusive of VAT and any other applicable taxes, which are your responsibility.
  • Subscription fees are non-refundable except as required by applicable law.
  • We reserve the right to change pricing with at least 30 days' written notice before the start of a new billing period.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulation.
  • Submit case data for patients without their appropriate consent under applicable data protection and clinical governance rules.
  • Share, sell, or transfer your account or platform credentials to any third party.
  • Reverse-engineer, decompile, or attempt to derive the source code of the platform.
  • Introduce any code, virus, or mechanism intended to disrupt, damage, or gain unauthorised access to the Service.
  • Use the Service in a way that contravenes your professional regulatory obligations as a dental practitioner.

Intellectual property

All rights in the OrthoPlanner platform, including software, design, content, and trade marks, are owned by or licensed to us. These terms do not grant you any ownership rights. Treatment plans and protocol sheets we produce for your cases are licensed to you for use in your clinic under the subscription; you may not redistribute or resell them.

Your data

You retain ownership of all patient case data and credentials you upload to the Service. By uploading such data you grant us a limited licence to use it solely to deliver the Service to you. We will handle your data in accordance with our Privacy Policy. You are responsible for ensuring you have the necessary consents and legal bases to share patient data with us.

Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total aggregate liability to you for any claim arising out of or relating to these terms or the Service shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim.
  • Treatment plans are provided as professional guidance. Clinical decisions remain the sole responsibility of the treating dentist.

Termination

Either party may terminate the subscription at the end of the current commitment period with 30 days' written notice. We may suspend or terminate your account immediately if you breach these terms, fail to pay fees when due, or if we are required to do so by law. Upon termination you will lose access to the platform; we will retain data in accordance with our Privacy Policy.

Governing law and disputes

These terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these terms shall first be referred to mediation. If unresolved, they shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may update these terms from time to time. The "last updated" date at the top of this page will reflect any changes. For material changes we will notify registered users by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised terms.
